No unregistered guests or visitors allowed. The maximum property capacity is 4 people.
By confirming your booking you are agreeing to adhere to the rental rules set forth in this listing:
Rental rules: Guest agrees to abide by the Rental Rules included in this Agreement at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. SECURITY DEPOSIT – The security deposit is not applied toward rent. The $150.00 security deposit will be refunded within fourteen (14) days after departure provided the following provisions are met: a) No breakage or damage is done to property or its contents, beyond normal wear and tear. b) No charges are incurred due to contraband, pets, smoking, movie rental, out of county telephone calls, or collection of rents or services rendered during the stay. c) No excessive cleaning required. d) No loss linens/towels or other equipment/amenities e) The Key is returned and home is left locked. f) The Guest (or any of Guest’s visitors) is not evicted by the owner (or representative of the owner), or the local law enforcement. g) No charges for early arrival and/or late check out h) Check out procedures followed All Guests understand they are solely responsible for any property damage, accident, death, injury to any person(s), or loss sustained by any person, including the loss of money, jewelry and other items of personal property, arising out of or in any way related to a Guests use of the premises. All Guests shall inspect and be familiar with the proper use and application of all items in the cabin prior to using them. The cabin amenities are subject to change without prior notice. Guest shall inform Owner immediately if the premises appears to be unclean or damaged upon Check-in. 2. REGISTERED GUEST RESPONSIBILITY –All reservation and security deposit charges must be paid in full before access is given to the cabin. Guests agrees to pay all costs, within ten (10) days of invoice, for any expenses related to the repairs, cleaning of the unit beyond normal wear and tear, or related to any theft or vandalism of any property from the unit, and additional charges incurred by the Guest during their stay. Property will be replaced and/or repaired at current retail value, labor cost, credit card fees, plus a minimum $50 service fee. An inventory of the cabin is taken prior to check-in and after check-out. Upon arrival, we ask that you inspect the rental property and report any problems within 2 hours. If not reported within the allotted time, Guest will be charged for any damages that are found at check-out inspection. Many of you will vacation with other couples, family members, or friends, but only one person signs the rental agreement. That person, the registered guest, is responsible for all facets of this rental agreement as outlined herein. 3. CANCELLATION/RESCHEDULING/NO SHOW/EARLY DEPARTURE - Cancellations affect owners significantly. Cancellations, rescheduling, or changes must be submitted in writing by the guest named in this Agreement/Contract and confirmed receipt by Owners. Cancellation policy is as follows: - Reservations cancelled at least sixty (60) calendar days before the check-in date will receive a 100% refund. - Reservations cancelled at least thirty (30) calendar days before the check-in date will receive a 50% refund. If you need to make changes to your reservation (add or subtract a night, change dates, etc.) you can do so twenty-one (21) calendar days or more prior to your scheduled arrival date. If you need a change made within twenty-one (21) calendar days of your scheduled arrival date, you may be able to add a night, depending on availability. You will not be able to subtract a night from your scheduled reservation. A fee of $25.00 will be charged to the Guest for changes in reservations. 4. OCCUPANCY/AGE RESTRICTIONS - The maximum occupancy for the cabin is 4 people. Any child one year old and above is considered an occupant and shall be included in the occupancy total. Rollaway beds, inflatable mattresses and/or sleeping bags are prohibited and no overnight guests are allowed. If you are found to exceed the maximum occupancy of the cabin, it will be considered a breach of contract and will result in immediate eviction with no refunds, rebates, or compensation. Age Restrictions - You must be at least 25 years of age to book a cabin with us. Upon check-in or after check-in the Owner reserves the right to immediately evict all guests, refuse service with monies forfeited if any breach of contract is determined. Owner reserves the right to request a copy of the registered guest's driver’s license to verify compliance with age restriction. 5. CONDUCT – Occupancy and use of premises shall not be such as to place the property in danger of damage or to disturb or offend neighbors. No parties, excessive speeding through neighborhoods, riding of ATV’s or Off Road Motorcycles/Dirt Bikes, excessive noise and/or obnoxious behavior, discharging of Firearms, or Fireworks, etc will be allowed. The Owners have the prerogative to terminate this Agreement /Contract and to demand that disruptive Guests vacate the premises, thereby forfeiting all rental fees to Owners. 6. NON-SMOKING – NO EXCEPTIONS! – NO smoking inside the cabin. Guests agree to pay not less than $350 for odor abatement if smoke is detected in the cabin. Smoking outside or on the deck is permitted. Tobacco products shall not be disposed of in the yard or on the property. 7. MOUNTAIN ROADS/WEATHER - We do not guarantee any road surface conditions. Most roads in the area are well maintained, but they can be curvy and steep. While these roads are routinely maintained, they may be bumpy at times. In the late fall, winter, and early spring it is possible to have hazardous road conditions due to weather. It is strongly recommended that all guests, during these seasons, have four-wheel drive and/or chains. Winter road conditions and maintenance are not guaranteed. We do not refund due to road or weather conditions. You are responsible for your transportation. We cannot provide transportation nor are we responsible for any towing charges you may incur during your stay. If the weather prevents you from leaving on your scheduled check out day, you will be responsible for the additional night(s) rent. 8. WILDLIFE – Your vacation rental is treated once a month for insects. Unfortunately, on occasions, these creatures still find their way indoors. While we cannot refund any monies for insects or wildlife encounters, should it arise, we will take the appropriate measures to correct the problem. Most cabin are in the mountains, as such, it is possible you may encounter Bear, Deer, Turkey, Bats, Ladybugs, Carpenter Bees, Wasps, Scorpions, Ticks, Ants, Chiggers, or other wildlife. Cabin doors left open during the Guest’s stay can allow wildlife/insects to enter the cabins. The owners will not accept responsibility for any injury or illness caused by said wildlife. It is imperative that you DO NOT FEED ANY ANIMALS you come in contact with. Feeding the animals directly or by not securing your trash can result in bodily injury or death. 9. CABLE/SATELLITE/INTERNET TV/INTERNET AND TELEPHONES - Guest agrees they are responsible for any billable charges of any kind. Any billable calls or pay per view movies made during the stated rental period and charged to the owner will be billed, along with a processing fee, to the guest upon receipt of the charges. Owner may not be aware of any unauthorized charges incurred by the Guest until the utility bill is received. Therefore, the Owner reserves the right to invoice the Guest for all charges incurred from the Guests stay. 11. MAINTENANCE, REPAIRS and REFUNDS – As with any home, the cabin has components that break or malfunction from time to time. In case of a breakdown of any property equipment, guests shall notify Owners immediately to make the necessary repairs. Owners will make every effort to correct any problem that arises during your stay in a timely manner however, Owners cannot guarantee against mechanical failure of cabin equipment. The cabin is equipped with a water filtration system, however, the water supply to the cabin is on a well and may have a sulfur smell. Unless the service request is deemed an emergency by the Owner, maintenance will respond during the hours of 9 am through 5 pm. However, Owners agree to do all that is humanly possible to remedy any issue as quickly as possible. Should a repair person make a call to repair or replace a unit that is found to be in working order and the problem was due to Guests oversight, neglect or misuse, Guests agree they shall be responsible for the cost of the service call. Power Outages - Sometimes in the mountains we experience power outages. If the power goes out, please understand water is on a well. You will not have water until the power comes back on. A well requires electricity to work. Having an extra gallon or 2 of water on hand is always a good idea. If you do experience a power outage during your stay, contact the Sevier County Electric System to report the problem and obtain more information. The owner has equipped the property with amenities to make your stay more enjoyable. Unfortunately, Owners cannot refund monies due to failure any of these amenities (TV, VCR, DVD, wood fireplace, hot tub, gaming system, small appliances, etc.) not working or malfunctioning. No refunds will be made for acts of God, loss of electrical power, water, air conditioning, cable outages, sulfur water smell, acts of neighbors (i.e. construction, road repair, maintenance), listing descriptions, bed sizes, and/or amenities. Guest shall not lower the air conditioning lower than 72 degrees Fahrenheit, which may cause the system to freeze up. In the event the system freezes due to low air conditioning temperatures the Guest will be responsible for all costs associated with a service call and repairs. Guest are requested not to adjust the refrigerator and freezer temperatures, which causes the unit to freeze. In the event the equipment freezes due to adjustments, the Guest will be responsible for all costs associated with a service call and repairs. 12. RIGHT OF ENTRY - Guests understand, and agree that Owners and their Agents reserve the right to enter property at any time to investigate disturbances, check occupancy, check damages, make repairs, alterations, and improvements. 13. FIREPLACES –Fireplaces are seasonal and are operational from October 1st through March 31. No item including but not limited to; charcoal, lava rocks, accelerants, etc., may be burned. Guests agree to pay damages, if any item, other than hardwood or Duraflame type logs are burned. Guests further agree that no fire will be left unattended. Guests are required to supply their own wood for the fireplace.. Guests will not make fire pits. Doing so is considered damages and the guest will be charged accordingly. Occasionally the fireplace needs repairs. We do not offer any refunds for them being out of order. Guests using the fireplace during the closed months will be charged a fee of $75.00. All ash shall be placed in the ash can at the back of the cabin. GUEST SHALL KEEP THE FLUE CLOSED WHEN NOT IN USE. 14. HOT TUBS - For Guest(s) safety and health, hot tub is drained, cleaned, disinfected, refilled, chemically treated, and tested following each stay. Please consult a physician if you have any questions or concerns regarding use of hot tub. USE AT YOUR OWN RISK! Water may therefore initially be cool. Overuse or misuse of the hot tub may result in a chemical imbalance and could create unhealthy water. Please observe all rules posted. If the water should become cloudy or develop an odor, please call the Owner. Guests may not add any objects, food, soaps, bath products, glass or chemicals to the hot tub and agree to pay damages if hot tub has been compromised. Guests agree to pay an additional charge of $50 if Guests request an additional cleaning of hot tub during Guests’ stay. Guests understand that hot tub usage is at their own risk and will not hold Owners responsible for any damages, injury or illness. It is absolutely forbidden for children to be in the hot tub without a responsible adult. All guests must follow hot tub rules posted at cabin. Any damage to the hot tub cover will result in a $400 charge. 15. GRILLS - The cabin is equipped with outside grills: 1) Large propane grill. Please clean up all grease and food spills. The Owner supplies the LP gas for the gas grill. 16. PET POLICY - AS AUTHORIZED BY OWNER. Any pet on premise shall result in automatic forfeiture of all monies paid, immediate eviction without refund, and a fine of no less than $200. Please do not jeopardize your vacation. 17. OWNER SUPPLIES TO GUEST – When you arrive at your cabin you will notice some of the supplies that are provided, including but not limited to; paper towels (1 roll), toilet paper (2 rolls), dish soap and trash bags. Once you have depleted the provided items, you are responsible for purchasing any additional items. All bed linens, towels, kitchenware, and utensils are inventoried upon check out. The registered guests will be charged for missing or damaged items. Linens and towels shall not be taken off premises. 18. HOUSEKEEPING and TRASH PICK-UP - Your vacation rental was thoroughly cleaned and inspected prior to your arrival. Please call the owner immediately to report any housekeeping issues. We will correct the problem as soon as possible. If you have more trash than will fit in the outside trash receptacle directions for trash deposit sites are provided in the information document. Owner is not responsible for trash strewn about by animals so make sure the lids are closed properly. Excessive cleaning requirements after departure of guests shall result in additional guest charges of $25.00 per hour. 19. FURNITURE/EQUIPMENT - Furniture and equipment shall not be moved in the interior or exterior of the cabin. Furniture being moved by guests shall result in additional charges of $50.00 to the Guest. 20. LOCKBOXES - A lockbox/keypad has been provided for your convenience at the cabin. The key must be placed back in the box immediately following each use. Should an emergency arise, it is imperative that the property be accessible. If a key becomes lost or misplaced there will be a minimum charge of $250 to have the property re-keyed. If a maintenance issue arises and we arrive at the cabin to find no key left in the lockbox and no one at the cabin, the Guest will be charged a $50 trip fee. 21. CHECK IN / CHECK OUT – Check-in time is no earlier than 3:00 PM; checkout is no later than 10:00 AM. By signing this Agreement/Contract, Guests are authorizing Owners to invoice guest should they check out later than 11:00 am. Guests checking out late will be charged $30 per hour or any portion thereof. There are no refunds for early departure. 22. ITEMS LEFT BEHIND- Owners are not responsible for any items Guests leaves behind in cabin. Owners are authorized to charge a fee of $35 plus shipping costs for the return of any items Guests leave behind in cabin. Lost and found items unclaimed after 30 calendar days will be turned over to local charities. 23. EXPEDITED EVICTION - A material breach of this Agreement by Guests, which, in the sole determination of the Owners, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guests tenancy. Violation of any of the rules contained herein will result in immediate eviction and forfeiture of rent and damage deposit. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in. 24. VIOLATION OF AGREEMENT/CONTRACT – Owners reserve the right to remove renter without refund, rebates, or compensation, if any of the Agreement/Contract items are not met. 25. INDEMNIFICATION AND HOLD HARMLESS – Guest acknowledges and understands that each and every guest or guardian is solely responsible for any property damage, accident, injury or loss sustained to any person while inresidence, and neither the Owners nor Agents accepts legal or financial responsibility. Guests, and guardians, assume all risk of injury or other loss and will hold the Owners and Agents harmless with respect hereto. Guests hereby agrees to indemnify and hold Owners and Agents harmless from any claims, including those of third parties, arising out of or in any way a result of the guests use of the premises or items therein. I understand and agree to pay all rent and accept all terms of the Rental Agreement/Contract, and accept all liability for any damages, beyond normal wear and tear, during the term of my stay at “it’s all good in the woods”. If I fail to do so, I understand and agree that costs are incurred I will be required to compensate the Owner within ten (10) of receipt of Owner’s invoice. All sales are final. I have read and agree to abide by all of the above documentation and regulations. I fully understand the responsibilities associated with this short term rental Agreement. Electronic acceptance of this Agreement constitutes binding acceptance and compliance of all terms and conditions set forth in the Agreement between the Owner and the registered Guest.
